Fulton County’s Business Court is Expanding Services to Gwinnett County

The Supreme Court of Georgia recently approved a revision to the Business Court Division Rule to allow Superior and State Court systems to join Fulton County’s current Business Court Division.

The State Bar of Georgia’s Business Court Committee explored numerous options to expand the Business Court Division’s model in the State of Georgia. After consideration of various models, the Committee agreed to a regional expansion approach which allows counties in the Metro Atlanta area to join. Gwinnett State and Superior Court system sought to be the first County to join the newly expanded Metro Atlanta Business Court. This newly developed expansion continues the Business Court Committee vision that businesses throughout the state would have access to a specialized business court to consistently and efficiently resolve complex commercial litigation issues.

Business Court Division Presiding Judge John J. Goger states, “This is only the beginning of enhancements to the Business Court program. Our intent is for other Superior and State Court systems in other regions of Georgia to emulate our regional Business Court model. We look forward to a rich partnership with Gwinnett County Courts and we are confident that the policies and procedures that we have jointly established will be adopted by other neighboring Metro Atlanta state and superior courts.”

The Business Court Division was established in 2005 and has developed a strong reputation for promptly resolving disputes. While the Division strives to rule on every motion filed within 30 days of the motion being fully briefed and heard, the average time for resolution of motions in 2013-2014 was approximately 15 days. In a survey of attorneys who had litigated in the Business Court Division between 2009 and 2011, an overwhelming number of attorney respondents viewed fast and efficient adjudication of cases to be a positive attribute of the Division. Since the announcement of the rule, the Business Court Division has already received notice from several Atlanta counties of their interest in joining.
